Terms of Service

These Terms of Service (“Terms”) govern your access to and use of QuoteNearby’s website, subscription service, pages, and related features (collectively, the “Services”).

QuoteNearby is operated by QuoteNearby (“QuoteNearby,” “we,” “us,” or “our”).

By accessing or using the Services, creating an account, subscribing, or submitting a quote request, you agree to these Terms. If you do not agree, do not use the Services.

1. What QuoteNearby Does

QuoteNearby is a local SEO and lead-generation platform. We build and maintain local search pages for subscribing service businesses, and we deliver homeowner inquiries (leads) from those pages to the subscribing business.

QuoteNearby does not guarantee specific search engine rankings, a particular number of leads, or any particular business outcome. Search results are determined by search engines and depend on many factors outside our control.

2. Eligibility

You may use QuoteNearby only if you are at least 18 years old, have legal capacity to enter into a binding agreement, provide accurate information, and comply with these Terms and applicable law.

3. Subscriptions and Billing

A. Free trial

New subscribers may be offered a 30-day free trial. During the trial, you are not charged. If you cancel before the trial ends, you will not be billed.

B. Monthly subscription

After the trial, the subscription is $99.99 USD per month, billed in advance on a recurring basis to the payment method you provide.

By subscribing, you authorize QuoteNearby and its payment processor (such as Stripe) to charge the recurring monthly fee until you cancel.

C. Service coverage and exclusivity

Your subscription covers the specific services you select at the primary city you designate. We assign each service in each city to one subscriber at a time: while your subscription is active, no other subscriber is granted the same service in that city, and quote requests for that service there are routed to you.

Exclusivity applies only to the services and city recorded at signup. It does not extend to services you did not select, to other cities or the wider metro area, or to requests from outside the location we can verify. Because one business covers each service in a city, adding a service later depends on whether it is still available at that time. When your subscription ends, the assignment is released and may be offered to another subscriber.

D. Renewals

Your subscription automatically renews each month until canceled. You will be charged the then-current monthly fee on each renewal date.

E. Cancellation

You can cancel anytime from your billing settings or by contacting us. Cancellation stops future renewals. You retain access until the end of the period you have already paid for.

F. Price changes

We may change future pricing. A price change does not retroactively alter a completed payment and will apply prospectively after notice where required.

4. Lead Delivery

When homeowners submit quote requests from your pages, QuoteNearby delivers those inquiries to you, typically by email. We do not guarantee that any leads will be received, that leads will be accurate or complete, or that any lead will result in a customer.

Requests for a service you hold in your city are routed to you. Where a request falls outside the services or the city assigned to you, we may route it to another participating business that covers it, and we may show the homeowner that no participating provider covers the request.

5. No Guarantee of Results

QuoteNearby builds and maintains pages using reasonable efforts, but we do not guarantee:

• specific search engine rankings;
• a particular volume of traffic or leads;
• that any lead will convert into a customer; or
• any particular timeframe for results.

Results depend on competition, location, services, search demand, and other factors outside our control.

6. Refunds

Refunds and credits are governed by our Refund Policy, which is incorporated into these Terms by reference.

7. Account Security

You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account. Notify us promptly if you suspect unauthorized use.

8. Acceptable Use

You may not:

• provide materially false information;
• impersonate another person or business;
• use stolen or unauthorized payment information;
• interfere with or disrupt the Services;
• scrape, crawl, or systematically extract data without permission;
• bypass access controls or payment requirements; or
• use the Services for unlawful, deceptive, abusive, or fraudulent activity.

9. Communications

By creating an account or subscribing, you agree that QuoteNearby may send operational communications relating to your account, leads, payments, and service updates. You may disable certain optional marketing communications where available.

10. User Content and Submitted Information

You retain ownership of information you submit. You grant QuoteNearby a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, format, transmit, and display submitted information as reasonably necessary to operate the Services and deliver leads. You represent that you have the right to submit the information you provide.

11. QuoteNearby Intellectual Property

The platform and its original content, software, designs, branding, and functionality are owned by or licensed to QuoteNearby and are protected by applicable laws. We grant you a limited, revocable, non-exclusive license to use the Services for their intended purpose.

12. Third-Party Services

We may depend on third-party services such as payment processors, cloud providers, analytics, and email services. We are not responsible for the independent conduct or availability of third parties.

13. Privacy

Our collection and use of personal information is described in our Privacy Policy, incorporated into these Terms by reference.

14. Suspension and Termination

We may suspend or terminate access where we reasonably believe a user has violated these Terms, provided false information, used the Services unlawfully, or created a security or fraud risk. You may stop using QuoteNearby at any time.

15. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” QUOTENEARBY DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL ALWAYS BE AVAILABLE OR ERROR-FREE.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUOTENEARBY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE SERVICES. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM OR $100. Nothing here excludes liability that cannot legally be excluded.

17. Indemnification

To the extent permitted by law, you agree to defend and indemnify QuoteNearby from claims arising out of your violation of these Terms, your unlawful use of the Services, or information you submit.

18. Governing Law

These Terms are governed by applicable law without regard to conflict-of-law principles. The specific governing jurisdiction should be confirmed before publication.

19. Changes to These Terms

We may update these Terms from time to time and will update the Last Updated date. For material changes, we may provide additional notice where appropriate. Continued use after changes become effective constitutes acceptance where permitted by law.
